Niccole Wetherell and Paul Gillpatrick were engaged in 2012. The state of Nebraska has prevented their wedding ever since​.

Wetherell is serving a life sentence for first-degree murder, housed in a prison about 50 miles away from her fiance, Gillpatrick, who is serving a 55-to-90-year sentence for second-degree murder.

The pair, who met in 1998, have come to accept they cannot marry in person. Instead, they want to wed via video conference, and they want an end to a prison policy that forbids Nebraska inmates from marrying each other except in “special circumstances.” Wetherell and Gillpatrick argue they have a “fundamental right to marry.”

In June, U.S. District Judge Robert Rossiter ​affirmed​ that right. The case is now in appeal. But the legal precedent Rossiter cited has a quirky history that involves an infamous co-ed prison, an impromptu wedding, a soon-to-follow divorce and a U.S. Supreme Court decision.

That decision, Turner v. Safley, established how courts should weigh the constitutionality of prison regulations, and has formed the legal basis for prison weddings across the country​—​most often between one incarcerated person and someone on the outside. It opened the doors for a niche industry of ​officiants​ ​who​ ​specialize​ ​in​ prison weddings. And its clear articulation of marriage as a fundamental human right was even cited in ​Obergefell v. Hodges​, the landmark Supreme Court decision that in 2015 affirmed the right to marriage for same-sex couples.

It’s Getting Hot in Here, So Take Off All Your Constructs

The album art for Megan Thee Stallion’s “Hot Girl Summer” has her riding a bottle of Hennessy like a bronco, with Nicki Minaj strapped in behind her. Both rappers have their arms up, their boobs out, their hair down. The flames around them are redundant. Before it was a song, Hot Girl Summer was a meme, with the 24-year-old freestyle genius dropping the mixtape Fever a month ahead of the summer solstice. That art is even better, a throwback to the flyest of fly blaxploitation: “She’s thee hot girl and she’s bringing thee heat” (more redundant flames surround her). Named Stallion for her statuesque beauty and with fans known as Hotties, Megan rebranded the aestival months as Hot Girl Summer. In the August issue of Paper magazine, she calls it a movement. The rapper told The Root that being a hot girl is not about being a certain type of sexy — it’s about “women, and men, just being unapologetically them.” But there are clear parameters here, which encompass a look — 5’11’’, hourglass — and a personality: “You definitely have to be a person that could be like the life of the party, and, you know, just a bad bitch.” Hot Girl Summer isn’t Taraji P. Henson in spectacles quietly doing actual rocket science, it’s Halle Berry in an orange bikini popping up out of the surf as Bond gawks. While Hot Girl Summer rejects the idea that a woman, notably a black woman, has to be answerable to anyone — a poignant reminder in a climate of rampant misogyny — the movement still implies a sexy young object of someone else’s desire. What Does It Mean To Be Moved?

“Why does a ripe apple fall?” Tolstoy asks in War and Peace. “Because the wind shakes it…or because the boy standing below wants to eat it?” Technically, the wind is the movement of air across space; but in our poetry, myths, and moving pictures, wind is something else entirely. For Tolstoy, it was the forces of nature tilting downward to meet man’s desire. For others, the wind is something that gives us permission, permission to move off course, to be blown away, to be held back longer from our destination, to act wild. In Homer’s The Odyssey, Aeolus, the divine keeper of the winds, hands Odysseus a bag containing all the winds of the earth. Aeolus conjures the west wind to send the men home. But just when they have Ithaca in their sights, Odysseus’s men, convinced the bag has gold inside, open it up. The winds escape and transform into a storm that sends their ship all the way back to Aeolus. However, this time he refuses to help them, certain Odysseus has been cursed by the gods.

We have rendered wind a metaphor for anger, passion, unreason; we use it as an excuse when we want permission to lose our minds. It is that extra push to be the person you really want to be, or to explain who we already in fact are. As Wallace Stevens put it “The wind shifts like this/ Like a human without illusions/Who still feels irrational things within her.” In Joan Didion’s Los Angeles Notebook, she writes about the strong, dry Santa Ana winds that leave coastal California in disarray, sometimes on fire. But for Didion, the Santa Anas are something else too; their arrival allows for a certain relinquishing of control. “We know it [is coming] because we feel it. The baby frets. The maid sulks. I rekindle a waning argument with the telephone company, then cut my losses and lie down, given over to whatever it is in the air.” I remember reading these lines for the first time and wishing for a wind like that, something that I could surrender to. Pages You Can Dance To: A Book List

In 1974 Walter Thompson, a Berklee-trained bandleader, moved to Woodstock and made up a language. A fan of improv, Thompson initially designed forty signs for structuring a live composition. With one gesture, he could single out a group in his orchestra (like “Woodwinds”). With another, he could instruct said group to hold a long note (“Long Tone”), match one another’s phrasing (“Synchronize”), or tell players to dit dit dit out a series of staccato bursts (“Pointillism”). Wham, Blam, thank you ma’am: a new song, on the spot.

Forty years later, directors working with all kinds of performers — actors, dancers, and musicians — still employ Thompson’s conducting shorthand to devise material. The language has a name now: soundpainting, a term I find almost unbearably lovely. At my (blessedly experimental) college I studied soundpainting, stage pictures, lyric essays, many radiant paradoxes that suggested trespass between one mode of making and another. But soundpainting, this word lingers. What a pure reminder that our creative borders are porous by definition. That some of our metaphors ought to be mixed.

Either Martin Mull or Frank Zappa or Elvis Costello or someone else entirely once may have said, “writing about music is like dancing about architecture,” and meant this as a cut. But like Thompson, I chafe against the arbitrary border. In this reader’s opinion, there are some excellent books about music. But on the synesthetic end of the exercise, there are also miraculous books suffused with music, there are rhythmic books that dit dit dit a forever impression on your skull. A man in Woodstock believes you can paint with sound. Well, I know for a fact you can dance to pages. Read more…

On a Wild Patch of Mississippi Soil

For Oxford American, freelance journalist and wanderer Boyce Upholt explores a large wooded island along the Mississippi River, appropriately named Big Island. It’s home to many legends about an old moonshiner and murderer named Perry Martin, but what draws the author back over and over, are its aura and the thick woods that somehow still preserve its wildness and beauty. This is the land called the Delta. I’ve visited it myself, and it quickly seduced me. Still reeling from the plantation slave economy, it’s one of the poorest parts of the US, and one of the most beautiful. Upholt’s brief travel dispatch shines a necessary light on this overlooked region, and challenges our modern notion of wildness.
On his frequent camping trips to Big Island, Upholt uses Mississippi River water to brew his morning coffee, which works against the long-standing notion of the trashed, tamed, polluted old river. As he says, “the thick woods and wide, sweeping sandbars are, in my opinion, among the most beautiful American landscapes.” Perry Martin is the embodiment of this landscape, as Upholt writes, “a tall tale, an emblem of the days when this place sat at the fringe of civilization, unbound by domesticity. “

The idea of a dismal Mississippi is one more story. While in its narrow beginnings in Minnesota there is often too much bacteria for safe swimming, the mighty river that runs through the Deep South is relatively clean. Indeed, the thick woods and wide, sweeping sandbars are, in my opinion, among the most beautiful American landscapes.

This river is not trashed. But it has been tamed: its path has been shortened and straightened; its southernmost thousand miles are sheathed in an intricate system of locks and levees, and now ninety percent of its old floodplain stands dry. This engineering, accomplished in pieces over three centuries, often came at the behest of the swell-heads who bought up the valley and demanded protections against the river’s floods. The U.S. government, to the tune of billions upon billions of dollars, acquiesced.

The greatest flurry of engineering came in the twentieth century, in the wake of the Great Flood of 1927. It’s probably no coincidence that Perry Martin abandoned Big Island soon after that flood. The U.S. Army Corps of Engineers began to install the floodways and spillways and dams and reservoirs that precisely managed the river’s flow; eventually, they paved the banks of the bends in concrete. From his perch in the batture, Perry Martin watched his former timber frontier be paved into a flowing machine.

Remembering Woodstock ’94

In hindsight, a tent would have been nice. A raincoat and boots. All I’d brought for “2 More Days of Peace and Music” at Woodstock ’94 was a sleeping bag and a backpack with a change of clothes. I remember thinking that in Indiana, the only home I’d ever known, it was hot as hell in August — how much different could the weather be in upstate New York? None of the people in my life, not friends nor family, found any fault with this logic. I was 19 with a year of college under my belt. I’d been working all summer as a camp counselor at the YMCA, nursing a broken heart. I didn’t care about the details, I just wanted to go.

From my vantage 25 years later, I’m equal parts horrified and impressed by my dumb faith in things just working out. So much has changed. Like everyone else these days, I feel self-conscious if I leave the house without my phone. Somebody now — my wife, my son, my employer — knows my whereabouts at all times.

It makes me wonder what that kid so eager to get to Woodstock would think of me. Would I seem soft to him?

Mountains, Transcending

It’s the winter of 1923 and a five-foot tall woman is shooting at brigands in Tibet. She’s surviving a blizzard by eating boot leather. She’s accepting a maggot-dancing stew from a drug-addled butcher and having a face-off with a snow leopard.

This woman is Parisian opera singer-turned-anarchist Buddhist lama Alexandra David-Néel, and she’s kicking through Tibet’s wild hills and steppes as she strides on foot across the Himalayas from Kanchow to Lhasa.

Alexandra’s starlit memoir recounting her adventure is no Thoreauvian nature journal. This is a tale that demands to be read in a cool bed while the night paws at the windows — or in my case, by the fire while my dad watches Come Dine With Me repeats on a black January afternoon.

I started reading My Journey to Lhasa because I love adventure stories. And while I’ve never pushed myself to extremes, still I felt a kinship with Alexandra. “Ever since I was five years old,” she wrote, “I craved to go beyond the garden gate, to follow the road that passed it by, and to set out for the Unknown.” She didn’t dream of towns or parades, but a solitary spot where she could “sit alone, with no one near.” As a child, her nannies often found her crouched behind bushes or hidden up trees in Paris gardens.

Quiet spaces — I’d needed those since I was a teenager.

I was most in search of a quiet space while teaching in Seoul in 2012. I was twenty-four and tired — of living in that crunching city of 26 million, of being in a job I was no good at, of lying awake in the self-hating 2 a.m. dark with a burnt throat from smoking cigarettes on the kindergarten rooftop. I wanted to feel clean again, like a child who’d spent the day by the sea. Read more…

Heartbreaker

Mom and I stand hunched over The Collected Poetry of Nikki Giovanni. She holds a box cutter in her hand as she flips a few pages into the book. The poem on the page is “Poetry is a Trestle.” She starts to carve, but quickly stops.

“Lock the door,” she reminds me. I do, and she relaxes.

Her fingers press into the pages, turning white as she cuts through inches of book. The pages’ centers slowly disappear, in their place a deepening rectangle. I quickly gather the scraps, putting them in the trash. From this point on, I am to keep my money in this book — my brother Liam discovered the old water bottle I’d kept in my junk drawer.

I have a lot of secrets to remember when I’m home. 0000 is the combination of the lockbox where Mom hides over-the-counter medicines like Advil and melatonin. The box is in the very back of the kitchen cupboard where we keep the cat food. Mom keeps a wad of cash in her wardrobe, buried underneath her underwear and socks. I’m not to open the drawer when Liam is around.

The Occupation of a Woman Writer

I woke up to the sound of someone speaking. It was late on Saturday at a large writing conference, nearing midnight. A man was performing a stilted Ginsbergian ode to the empty hallway outside my hotel room, his voice so loud that my eardrums were rattling with couplets. Headphones and pillows couldn’t block the noise out. I shifted and frowned. He must not realize I can hear him, I thought. I shrugged off the sheets and called the front desk.

The receptionist assured me that security would come upstairs soon. A pause in the man’s rambling followed, and the silence held for a few minutes. Then it was broken; again he began to boom. I cracked open the door so that I could just glimpse a sliver of him at the end of the hall, a sheaf of papers clutched in his hands. I sighed, guessing that he had seen the security guard and cut off his reading before he could be identified as the culprit. I called again and again. It took four times before the security guard finally caught him bellowing and asked him to stop. By then, it was four o’clock in the morning.

I heard the elevators contract. A beat. And then: “Fuck you!” he screamed. “Fuck you! You’ve never heard great poetry before! You fucker!”

Alone in the suddenly quiet room, I marveled at the arrogance of this man, surely another writer at the same conference I was attending. How much ego was necessary to power that level of misplaced rage? How would I feel if I realized that I had forced a floor of strangers to listen to my cluttered first drafts? I knew: embarrassment, guilt, distress. His reaction was so foreign to me that I had trouble comprehending it. And yet there was some part of me that had suspected he might not go gently into the night. That inkling had stopped me from confronting him myself. Men can be combustible creatures. Better to wait outside the impact radius, if you can.

Nashville contra Jaws, 1975

June 1975, six weeks after Time magazine headlined the Fall of Saigon as “The Anatomy of a Debacle” and wondered “How Should Americans Feel?,” brought two antithetical yet analogous movies: Robert Altman’s Nashville and Steven Spielberg’s Jaws. Each in its way brilliantly modified the cycle of “disaster” films that had appeared during Richard Nixon’s second term and were now, at the nadir of the nation’s self­-esteem, paralleled by the spectacular collapse of South Vietnam and the unprecedented Watergate drama.

In fact, in their time, Jaws and Nashville were regarded as Watergate films and, indeed, both were in production as the Watergate disaster played its final act in the summer of 1974. On May 2, three days after Richard Nixon had gone on TV to announce that he was turning over transcripts of forty-­two White House tapes subpoenaed by the House Judiciary Committee, the Jaws shoot opened on Martha’s Vineyard with a mainly male, no-­star cast. The star was the shark or, rather, the three mechanical sharks — one for each profile and another for stunt work — that, run by pneumatic engines and launched by a sixty-­five­-foot catapult, were created by Robert Mattey, the former Disney special effects expert who had designed the submarine and giant squid for the 1956 hit Twenty Thousand Leagues Under the Sea.

Brought to Martha’s Vineyard in pieces and cloaked in secrecy, Mattey’s sharks took longer than expected to become fully operational, and Jaws was further delayed by poor weather conditions. Accounts of the production routinely refer to the movie itself as a catastrophe only barely avoided: “All over the picture shows signs of going down, like the Titanic.”

In late June, a month when Jaws was still unable to shoot any water scenes, and while Nixon visited the Middle East and Soviet Union in a hapless attempt to, as the president wrote in his diary, “put the whole Watergate business into perspective,” Altman’s cast and crew arrived in the city of Nashville. They were all put up at the same motel, with everyone expected to stick around for the entire ten­-week shoot.

There is a sense in which Nashville represented a last bit of Sixties utopianism — the idea that a bunch of talented people might just hang out together in a colorful environment and, almost spontaneously, generate a movie. Even by Altman’s previous standards, Nashville seemed a free­form composition. It surely helped that neophyte producer Jerry Weintraub’s previous experience lay in managing tours, for Frank Sinatra and Elvis Presley among others, and packaging TV specials. Read more…
