Jennifer Wynn’s job is to make jurors feel sympathy for people who’ve committed unspeakable crimes

“We hear all about the victims,” Jennifer Wynn told me recently, “but we never hear about the defendant’s story.”

Wynn, cheerful and salty, is a mitigation specialist. She is engaged by defense attorneys, mostly in capital cases, to investigate and compile the life story of the defendant. The material Wynn gathers, often heartbreaking and brutal, is used to convince the jury to deliver a sentence other than death. (In non-capital cases the same person is called a sentencing advocate, and they similarly argue for a less-severe sentence.

She has now done mitigation work on 30 murder cases, 25 of which were death penalty-eligible, and won them all.

When people share with you their deepest, darkest secrets — the worst things they’ve done — they need validation. These are people who, for the most part, have been told their whole lives, You’re a piece of shit. They’re bullied, they’re picked on, they’re shot at. Then they act out, and society says, See, you are a monster. Then, people like me come in and say, No, you’re not a monster, and you still do deserve to be part of the human race. The system is fucked up, and I tell them that. It’s the first time they’ve ever heard that.

On the Thin Line Separating Honesty from Rudeness

Just like beauty, rudeness is confusingly both in the eye of the beholder and a universal phenomenon, something we’re supposed to recognize in an instant. At The New York Times Magazine, Rachel Cusk explores the complicated question of politeness from various angles — from Brexit and the Trump presidency to airport security checks and in-store shopping etiquette. But she also dives deep into the fundamental difficulty of separating honesty from being plain rude.

Are people rude because they are unhappy? Is rudeness like nakedness, a state deserving the tact and mercy of the clothed? If we are polite to rude people, perhaps we give them back their dignity; yet the obsessiveness of the rude presents certain challenges to the proponents of civilized behavior. It is an act of disinhibition: Like a narcotic, it offers a sensation of glorious release from jailers no one else can see.

In the recollection of events, rudeness often has a role to play in the moral construction of a drama: It is the outward sign of an inward or unseen calamity. Rudeness itself is not the calamity. It is the harbinger, not the manifestation, of evil. In the Bible, Satan is not rude — he is usually rather charming — but the people who act in his service are. Jesus, on the other hand, often comes across as somewhat terse. Indeed, many of the people he encounters find him direct to the point of rudeness. The test, it is clear, is to tell rudeness from truth, and in the Bible that test is often failed. An unambiguous event — violence — is therefore required. The episode of the crucifixion is an orgy of rudeness whose villains are impossible to miss. The uncouth conduct of the Roman soldiers at the foot of the cross, for instance, can be seen in no other light: Anyone thinking that Jesus could have done a bit more to avoid his fate is offered this lasting example of humanity’s incurable awfulness. They know not what they do, was Jesus’ comment on his tormentors. Forgive them.

How David Bowie Came Out As Gay (And What He Meant By It)

People like Lou and I are probably predicting the end of an era … I mean that catastrophically.
Any society that allows people like Lou and me to become rampant is pretty well lost.

On Sunday afternoon, 16 July 1972, David Bowie held a tea-time press conference at the Dorchester, a deluxe five-star hotel on London’s Park Lane. Mostly for the benefit of American journalists flown in to watch him and his new backing band, The Spiders from Mars, in action, the event was also a chance to show off Bowie’s new ‘protégés’, Iggy Pop and Lou Reed. They had – separately – made their UK live debuts on the two preceding nights, at the exact same venue, King’s Cross Cinema.

Glammed up in maroon-polished nails and rock-star shades, Reed sashayed across the second-floor suite and kissed Bowie full on the mouth. Sitting in the corner, Iggy also displayed a recent glitter makeover, with silver-dyed hair, eye make-up and T. Rex T- shirt. Reed, Iggy and Bowie would later pose for the only known photograph of the threesome together, Bowie looking resplendent in a flared-cuff Peter Pan tunic made from a crinkly, light-catching fabric. That was just one of three outfits he wore that afternoon – surely the first time in history a rock’n’roll press conference involved costume changes.

During a wide-ranging and somewhat grandiloquent audience with the assembled journalists, Bowie declared: ‘People like Lou and I are probably predicting the end of an era … I mean that catastrophically. Any society that allows people like Lou and me to become rampant is pretty well lost. We’re both pretty mixed-up, paranoid people, absolute walking messes. If we’re the spearhead of anything, we’re not necessarily the spearhead of anything good.’ What a strange thing to announce – that you’re the herald of Western civilisation’s terminal decline, the decadent symptom that precedes a collapse into barbarism or perhaps a fascist dictatorship. But would an ‘absolute walking mess’ really be capable of such a crisply articulated mission statement? There’s a curious unreality to Bowie’s claims, especially made in such swanky surroundings. Yet the reporters nodded and scribbled them down in their notepads. Suddenly Bowie seemed to have the power to make people take his make-believe seriously … to make them believe it too. Something that in the previous eight strenuous years of striving he’d never managed before, apart from a smatter of fanatical supporters within the UK entertainment industry.

Some eighteen months before the Dorchester summit, the singer had looked washed-up. Deserted by his primary collaborators Tony Visconti and Mick Ronson, he put out the career-nadir single ‘Holy Holy’. (Can you hum it? Did you even know it existed?)

Yet a little over a year later, Bowie had everybody’s ears, everyone’s eyes. His fortunes had transformed absolutely: if not the biggest star in Britain, he was the buzziest, the focus of serious analysis in a way that far better-selling contemporaries like Marc Bolan and Slade never achieved. No longer a loser, he had somehow become the Midas man, a pop miracle-worker resurrecting the stalled careers of his heroes, from long-standing admirations like Lou Reed to recent infatuations like Iggy Pop and Mott the Hoople. Sprinkling them with his stardust, Bowie even got them to change their appearance in his image. There was talk of movies and stage musicals, the sort of diversification that’s tediously commonplace in today’s pop business, but back then was unusual and exciting.

‘People look to me to see what the spirit of the Seventies is,’ Bowie said to William S. Burroughs in a famous 1974 dialogue convened by Rolling Stone. This was not boasting, just the simple truth. How did Bowie manage to manoeuvre himself into place as weathervane of the zeitgeist? The battle was not won on the radio airwaves or at record-store cash registers. There are bands from the early seventies who sold millions more records than Bowie ever did, but they never came near to having the high profile he had at the time and are barely remembered today. From Food Scraps to Profit: The Compost King of New York City

At first, I didn’t know what to make of Charles Vigliotti. You seldom hear the words “wealthy” and “composter” strung together. But as he explained his roundabout path to the energy sector, I began to sense Vigliotti’s commitment to solving some serious environmental problems, even as he lined his silky pockets.

After city landfills began closing in the 1980s, Vigliotti found he was spending too much money directing waste out of state. He began to move away from the trash business and in 1991 established with his brother Arnold a compost company in Westbury, N.Y., that transforms Himalayas of landscape debris — grass clippings, leaves, wood chips — into millions of bags of lawn and garden products. Business was good, but Vigliotti remained restless. In 1999, he opened a compost site in Yaphank, where in 2008 he began dabbling in food waste, mixing scraps from a Whole Foods Market and a small-batch won-ton manufacturer into his formula for potting soils. At this point, Vigliotti wasn’t thinking of food waste as a renewable energy source or a way to reduce the city’s far-flung garbage footprint or greenhouse-gas emissions. It was simply a way to take in more volume and thus make more money.

Trilby, the Novel That Gave Us ‘Svengali’

In the fall of 1894, a New Jersey reader wrote to George du Maurier, the Franco-British author and satirical cartoonist whose Harper’s Monthly serial, Trilby, had just come out as a novel. The concerned correspondent asked that his mind be put to rest regarding the decorousness of relations between Trilby, the young heroine, and musical genius Svengali, under whose hypnotic spell she becomes an overnight opera sensation. Du Maurier replied politely but briefly: “I beg to say that you are right about Trilby. When free from mesmeric influence, she lived with him as his daughter, and was quite innocent of any other relation.” His assurance was published in The Argonaut, a San Francisco weekly, thus alleviating any similar fears for the girl’s reputation among that paper’s readership. In Brooklyn, meanwhile, a woman had a disagreement with her husband over Trilby’s morals, culminating in her smashing an earthenware jar over his head. Luckily for the woman, the injured party declined to give evidence in court. Perhaps he appreciated that when it came to Trilby, emotions ran high.

Irish-Scotch-French model and laundress Trilby O’Ferrall was partly based on real women, including a 17-year-old girl, nicknamed Carry, whom du Maurier and his friend Felix Moscheles knew as art students—and amateur mesmerists—in Belgium in the late 1850s. With her “rich crop of brown hair, very blue inquisitive eyes, and a figure of peculiar elasticity,” Carry modeled nude for them and allowed herself to be hypnotized. Her soul, Moscheles later claimed, “was steeped in the very essence of Trilbyism.” Du Maurier’s granddaughter, the novelist Daphne du Maurier, concurred: “Carry . . . had the same camaraderie, the same boyish attraction, the same funny shy reserve.” Another inspiration was Anna Bishop, an opera star reputed to be in sinister thrall to her older lover-manager, the French harpist and composer Robert Nicolas-Charles Bochsa. In 1839, Bishop caused a scandal by leaving her husband for Boscha, and to his musical accompaniment, the legend went, she sang as she never had before. Read more…

Giving the Ultimate Gift: Granting the Wish to Die at Home

At The Australian, Andrew McMillen writes on palliative care as a critical service, and of the “power and the grace” required to care for those who are terminally ill and grant their final wish: to die peacefully, at home.

On an adjustable bed in a room towards the front of the house is Tony Huelsmann, a retired dancer, choreographer and dance instructor whose skills were once in high demand at schools throughout Melbourne and Brisbane. Sandra was one of his dance students. He was 30 when they met, seven years older than her, and it was love at first sight.

Born in Germany, Tony has spent much of his life in Australia. Now 80, he is dying from complications associated with several internal and ­external cancers, including a rash of angry red squamous cell carcinomas that have colonised the skin of his swollen upper thighs. These painful sores require daily dressings, performed by a personal care worker, while Karuna’s rotating ­roster of nurses help with symptom management, bed-baths, toileting and bedding changes, as well as emotional support for both husband and wife.

Since May, Tony’s world-spanning life has been confined more or less to these four walls while Sandra cares for his every need. At night, she snatches sleep where possible. It is their wish for Tony to die at home and they are both determined to see this wish fulfilled.

“A good palliative care nurse should be invisible,” she says, while navigating her hatchback between house visits. “You’re there to help them negotiate the process with friends and loved ones. The Dalai Lama says compassion should be selfless: it’s not about you, it’s about them. You’re a springboard. But it’s a real dance: you’re not a robot, and you go in with your whole self and heart open. We’re all emotionally involved, and the moment you’re not – when it becomes mechanical – I think you should quit.”

By midday Friday, Tony has lost more strength and lucidity. Swollen from the waist down, he has little control of his body. Today, for the first time, he is unable to use scissors to cut the tape that his wife uses to dress his sores. When Karuna nurse Kate Hooper visits his bedside, Tony clocks her prominent baby bump. A man near death meets a woman weeks away from giving birth. Pointing a shaky finger, he smiles and rasps to her, “How long to go?”

‘4 the Boys’: The Tunnel Creek Avalanche, Five Years Later

At Seattle Met, Eva Holland talks to the survivors and explores the aftermath of the Tunnel Creek avalanche — the tragedy that inspired “Snow Fall” — five years after a massive snow slide claimed the lives of three men.

“The Boys,” in this small, ski-crazy community, is shorthand for three well-known, well-loved local men who were killed in an avalanche at Tunnel Creek, in the Stevens Pass backcountry, on February 19, 2012: Chris Rudolph, 30; Jim Jack, 46; and Johnny Brenan, 41. The men were part of a large group of visitors and local legends who ventured out of the resort gates late on a Sunday morning and were caught up in a massive snowslide.

Avalanches kill an average of 27 people in America every year. This one attracted the attention of the national media. Good Morning America and Today came calling, wanting to speak to the survivors just hours after the slide. Magazines, including Outside and Men’s Journal, published major features on the tragedy. And, most famously, The New York Times spent months producing “Snow Fall,” an ambitious, multimedia feature about the avalanche that would go on to redefine how stories are presented online. Written by John Branch, it won a Pulitzer Prize, spawned hundreds of imitators, and is now taught in journalism schools.

That’s when the snowpack on the hillside let go.

It shed more than 2,500 feet in altitude in a matter of seconds, gaining mass as it went, ripping up trees and rocks along the way and reaching a peak speed of about 70 miles per hour. The New York Times estimated its weight at 11 million pounds.

Eating In Public Is a Spectator Sport When You’re Fat

Being fat means never being allowed to ignore your fatness. After navigating a lifetime of being fat (and ashamed) in the US, Jonatha Kottler moved to the Netherlands and found a whole new universe of exclusion, which she describes in an essay in New York Magazine.

One day, about 12 weeks after blowing up my whole life and moving my family to what seemed like a very hostile environment, my son and I decided we would go to the cinema and see The Great Gatsby to cheer ourselves up and feel less homesick. We did what we sometimes did at home — skipped dinner to have popcorn for dinner instead. Already flummoxed by having to preorder our tickets for assigned seats on a Dutch website (none of these were cinema-hurdles back home where you’d just walk up and buy a ticket), we arrived at the cinema. We bought the largest popcorn (which is in fact a product they sold — we didn’t bring our own trash barrel and ask to have it filled) and settled in to enjoy our treat. I felt a tap on my shoulder, which was strange since I knew a total of three people in the entire country. I spun around, startled, and the Dutch man sitting behind me said, “Are you going to eat all of that? I see why you are so fat.”

The Changing Formation of the Modern American Family

The dynamics of what constitutes the American family is rapidly changing. According to a 2014 PEW study, less than half—46 percent, to be exact—of children younger than 18 years old are living in a home with “married heterosexual parents in their first marriage.”

And it’s not just that adults are waiting longer and until they’re farther into their careers to conceive: PEW reported a year later that 16 percent of children live in ‘blended families’ (e.g. a household with a stepparent or a stepsibling); in the same study, it also announced that while seven percent of kids live with cohabiting parents, some estimates expect that rate could jump to nearly 40 percent by the time that child becomes a teenager.
