The Law Is Human and Flawed

What is lawful is not always identical to what is right. Sometimes it falls to a judge to align the two. Ward’s judgment runs to more than eighty closely typed pages. It is beautifully written, delicate and humane, philosophically astute, ethically sensitive, and scholarly, with a wide range of historical and legal references.

The best of judgments, as I was to discover, are similarly endowed. They form a neglected sub-genre of our literature, read in their entirety by almost no one except law studentsand fellow judges. And in the Family Division particularly, they present a hoard of personal drama and moral complexity. They are on fiction’s terrain, even though they are bound, unlike the fortunate novelist, to a world of real people and must deliver a verdict.

But as we all know, verdicts, indeed the whole system, can also be asininetough, even tragic, for its innocent victims, grimly fascinating for the novelist. For the obvious is true, the law is human and flawed. Just like newspapers or medicine or the internet, it embodies all that is brilliant and awful about humankind.

How a 26-Year-Old From Dallas Turned Fashion Blogging Into Big Business

Affiliate marketing is almost as old as the Internet; it developed back in 1994 thanks to pornography sites, and it was implemented by Jeff Bezos at Amazon shortly afterward. Here’s how it works: Say you search for flights on Priceline. The hyperlinked airfare results aren’t just any old links. They’re affiliate links. The act of clicking one saves a Priceline cookie to your browser before sending you on to the airline’s website. If you buy the ticket, the airline website will see Priceline’s cookie and will pay Priceline a commission. Affiliate marketing companies like Commission Junction and Linkshare, which created these trackable links, were aimed at developers. A company called Skimlinks made them easier to implement, but it didn’t focus on the fashion market. Baxter, who had interned at a tech start-up in San Francisco, saw an opportunity. If they could make it easy for bloggers to integrate affiliate links to retailers into their posts, everyone involved stood to profit. Retailers could make more sales. Bloggers could earn commissions. And a company that facilitated the transaction and negotiated the commission could take part of the proceeds. After all, many prominent bloggers were already including retail links in their #OOTD (“outfit of the day”) posts anyway.

Sitting at Starbucks, Amber could immediately envision the company. She decided it should be called rewardStyle, and while she was designing the logo on a napkin, Baxter used his iPhone to register the domain name. By February 2011, they had a test platform for the site. She reached out to a few blogger friends and asked them to try it out. “You don’t have to pay anything, you don’t have to sign any contracts, you just have to see if you start making money,” Amber said.

What Ails Us: A Reading List About Disease

In last week’s Reading List, I wrote about Eula Biss and her new book, On Immunity: An InoculationIt is a meditation on the United States, disease, race and motherhood, using vaccination as a metaphor/catalyst. With that on my mind, this week’s list is about diseases—four essays about Ebola, Parkinson’s and more.

In a combination of memoir and science writing, from her father’s careful logs to the books she reads to her ailing mother, AuBuchon comes to realize “we come from people who listen and people who believe in stories, because stories are the only thing getting them from one moment to the next.”

‘The Library Is One of the Few Civic Spaces We Have Left’

I have a dear friend who’s working at the library in Chattanooga, which is one of the rare states where the budget is increasing, and she’s doing all of this neat stuff with technology: bringing in 3-D printers, teaching web-use skills, all of these public services that are really necessary beyond making books available for people. I’m bullish on the need for libraries. I’m pessimistic about our ability as a society to come together and pay for their small sanctuary if our public services are under attack.

The library’s one of the few civic spaces we have left. People are feeling like there’s no other ways for these online platforms and services to be run, it’s our destiny to have them be privately run, and yet we invoke the analogy of the library or archive all the time. To me it says that we find it realistic that Google will be our archive when it’s an advertising company. We’ve seen them get rid of services that are not profitable (Google Reader), and we’ve seen them demote things like Google Scholar. That’s realism, where it’s unrealistic to think we’d build on the success of the library with a national repository for knowledge, arts, and culture?

Libraries exist and they’re open. Libraries exist with all these values we invoke in the digital sphere, but there are very few people thinking about how we might build upon them.

The Novel That Was a Key to Solving a Polish Murder Mystery

Bala had since moved abroad, and could not be easily reached, but as Wroblewski checked into his background he discovered that he had recently published a novel called “Amok.” Wroblewski obtained a copy, which had on the cover a surreal image of a goat—an ancient symbol of the Devil. Like the works of the French novelist Michel Houellebecq, the book is sadistic, pornographic, and creepy. The main character, who narrates the story, is a bored Polish intellectual who, when not musing about philosophy, is drinking and having sex with women.

Wroblewski, who read mostly history books, was shocked by the novel’s contents, which were not only decadent but vehemently anti-Church. He made note of the fact that the narrator murders a female lover for no reason (“What had come over me? What the hell did I do?”) and conceals the act so well that he is never caught. Wroblewski was struck, in particular, by the killer’s method: “I tightened the noose around her neck.” Wroblewski then noticed something else: the killer’s name is Chris, the English version of the author’s first name. It was also the name that Krystian Bala had posted on the Internet auction site. Wroblewski began to read the book more closely—a hardened cop turned literary detective.

David Grann’s “True Crime,” is a strange story of a Polish detective who becomes fixated on a disturbing, provocative, postmodern novel that may be the key to a brutal unsolved murder. The story is fascinating and layered, and I’m guessing I’m not the only ex-liberal arts student who will find aspects of the main suspect’s character uncomfortably familiar.

‘If You Want to Be Famous, Don’t Be a Writer’

I’m always curious about the relationship between ambition and fame. On one hand, the desire to be a famous writer can be useful—you have to have drive, ambition. You need to be balls-out doing what you’re going to do to have any hope of success. But on the other hand, so many writers conflate ambition with wanting to be famous. Particularly in the era of internet fame, whatever that is. Did you aspire to being a famous writer?

I want be recognized for beautiful work, for good work, for real work. I really want to be recognized for that. Which is different than saying I want to be famous.

If you want to be famous, don’t be a writer. When I was first thinking of myself as a writer back in my teens, the shorthand for that was fame. But then I started to really understand what writing was and who writers were. Who were the writers I valued the most as a young woman learning to write? They were people like Alice Munro, Raymond Carver, Richard Ford, Mary Gaitskill, Toni Morrison.

Those people I just named are super famous in our world, but most of the world doesn’t know them. So pretty quickly, to me it wasn’t about fame—it was about accomplishment. Once you let go of that fame thing, it’s the first step in really being able to focus on doing good work.

Because you can’t fake it. That’s the deal with writing. You can’t fake it. You read an Alice Munro story—it’s there or it’s not, you know? So I let that go pretty early on.

With fame, you have to get over it. You do. Because you will actually not succeed because of it.

Who Counts as a 'Public Figure' in the Age of Social Media?

By the time I had a few thousand followers on Twitter, people began to refer to me as a “public figure.” While mine was a paltry fame compared to literally thousands of cishet white men in the industry, that type of visibility for women is far rarer due to sexism, misogyny, online harassment, the way intellectual labor by women is devalued, and the costs of exposure to women in the field.

I soon realized that calling me a “public figure” had nothing to do with describing my impact on the industry or recognizing my achievements within it. Rather, the term “public figure” is solely ascribed to me as part of justifying abuse, harassment, humiliation, boundary violations and invasion of my privacy by anyone – from journalists to anonymous trolls to professional peers. When I protest journalists using bullying and dishonest tactics to exploit my life and relationships for page views, I’m a “public figure” and thus not allowed any privacy or boundaries, or to defend myself in any way. When my experiences and words are twisted, taken out of context and used against me as attacks; when months of my tweets are dug through to find a scrap of something to attack me with: “well you live your life in public!”

Ironically, as I have become a “public figure,” I am less and less able to exist in public.
